Terms and Conditions
Please read carefully through the following terms and conditions (“Terms and Conditions”) before you sign, date and return our booking form to us. By completing and signing the booking form you acknowledge that you are subject to the Terms and Conditions stated below and that you are also agreeing to be bound by them.
Definitions
“the Cottage” means Marlin Spike Cottage, Runswick Bay, North Yorkshire
“the Owner”, “us” or “we” means the legal owner(s) or other person(s) for the time being who hold legal title to the Cottage or who are entitled to its rental income.
“your Holiday” means the period of time specified on the booking form (and which has been agreed by the Owner) and for which the Lead Holidaymaker and the holiday party are to occupy the Cottage for the purpose of enjoying a holiday only.
“the Lead Holidaymaker” is the person reserving the Cottage for the Holiday.
1. Before completing and returning our booking form please ensure that you first check the availability of the Cottage with the Owner.
2. Provisional bookings can be made once the availability of the Cottage has been confirmed by the Owner. A provisional booking will be kept open for 7 working days only from the date of any such provisional booking. If a completed booking form together with a deposit 50% of the rental monies is not received by the Owner within 7 working days of any such provisional booking then the booking will be deemed to have been cancelled by the Lead Holidaymaker and the holiday party.
3. The lead name on the booking form (“the Lead Holidaymaker”) will be held responsible for the behaviour of the entire holiday party and also for the condition in which the Cottage is left at the end of the Holiday.
4. The Lead Holidaymaker must be over the age of 25 years and the ages of all members of the holiday party must be accurately disclosed on the booking form.
5. No contract exists between the parties until a completed booking form and a deposit of 50% of the rent for the Cottage have been received by the Owner and a contract is only formed when the Owner of the Cottage sends the Lead Holidaymaker written confirmation of the booking.
6. Thereafter the Lead Holidaymaker becomes liable for the balance/final payment of the rent and this must be paid 2 weeks prior to the date of the commencement of the Holiday. The Owner shall not be under any obligation to issue a reminder to the Lead Holidaymaker about final payment of rent due and it is the responsibility of the Lead Holidaymaker to ensure that this payment is made within time.
7. If you book your Holiday within 2 weeks of the commencement of your Holiday then the whole of the rent must be paid when the booking is made.
8. The booking shall be deemed to be for the purpose of the people whose names appear on the booking form and the Cottage is offered on the strict understanding that no more than 6 people shall occupy it. We reserve the right to refuse or curtail any booking where it subsequently transpires that the Owner has been mislead by the information given on the booking form regarding the number and ages of people staying at the Cottage. Bookings will not be accepted from parties of young people under the age of 25. The Owner also reserves the right to refuse or revoke any bookings from parties which they may in their opinion unsuitable for the Cottage.
9. We only accept payment by personal cheque and this is deemed to have been received by us on clearance of any such cheque.
10. If you cancel your booking for which you have contracted with us, we will do what we can to re-let the Cottage, and if we are successful we will refund any payment made by you less a handling charge of £20.00 for every week booked however depending upon the circumstances of the cancellation we may waive this fee. If we are unable to re-let the Cottage, then you will remain liable for the balance of rent (if not already paid) and there shall be no obligation on our part to repay or forego any rent paid.
11. On the very rare occasions and under exceptional extreme circumstances it may be necessary for the Owner to offer you alternative holiday accommodation to the Cottage which you have booked. If the substitute accommodation is not acceptable to you then you will be entitled to a full refund of any deposit and/or rental which you have paid. Should you choose a full refund then the Owner will not be under any further obligation to you as you will have declined the alternative accommodation offered.
12. In order that the Property can be cleaned and inspected between rentals, holidays commence at 3.00 pm on the day of your arrival and terminate at 10.00 am on your departure day.
13. The Lead Holidaymaker is to ensure that the Cottage is left in a clean and tidy state when you leave after your Holiday.
14. The Lead Holidaymaker will be responsible for any damage to the Cottage including any damage done to the furniture fixtures fittings and effects at the Cottage. Anything broken or damaged should be reported to the Owner as soon as possible and paid for before departure, in default of which, the Lead Holidaymaker will be obliged to reimburse the Owner against any cost or costs incurred by the Owner in remedying any damage or breakages which occur during the Holiday and which have not been reported to the Owner prior to your departure.
15. The Lead Holidaymaker must ensure that nothing happens which may be a nuisance or inconvenience to the owners and occupiers of any neighbouring property or to allow any act or thing to happen which may adversely affect any insurance of the Cottage.
16. Electricity is included in the price of your Holiday and free coal is available for the open fire in the sitting room.
17. All the beds at the Cottage have duvets and pillows and bed linen is provided, however, no towels or kitchen linen is provided so you should bring your own.
18. Two spaces available away from the Cottage in the village. Details of the location of the parking spaces will be given once confirmation of your booking has been made.
19. Dogs are permitted at the Cottage with the prior approval of the Owner. When booking please state the breed and number of dogs you wish to bring to the Cottage. If we accept your dog(s) please make sure that under no circumstances are:
(a) your dog(s) left at the property unattended.
(b) Your dog(s) must not be allowed upstairs, in the bedrooms, or be allowed to sit or sleep on any of the furniture in the Cottage.
(c) Your dog(s) must not be allowed to foul the inside of the Cottage, its garden or any surrounding areas.
No other pets are accepted at the Property.
20. No complaints will be considered after the completion of your Holiday unless they were raised with the Owner during your stay.
21. Please remember that every rental property is different and so is every resort. Standards can vary according to local conditions. Whilst everything is done to ensure that all equipment and facilities at the Cottage are in proper working order should you experience a problem with the Cottage or any of its equipment please contact the Owner immediately and ask for the problem to be rectified If you feel you have a genuine complaint in respect of the Cottage then this should also immediately be reported to the owner. We will endeavour to rectify any problem as soon as is reasonably practicably possible to do so.
22. Every reasonable efforts will be made by us to advise you of any situation which may affect your holiday. We cannot accept liability for any disturbance which may occur and which is outside of our control.
23. No liability is accepted by the Owner of the Cottage in respect of loss or damage to any member of the holiday party, their baggage, motor vehicle(s), resulting from riot, war, strikes, adverse weather conditions, sickness, injury or for loss or damage by any third party.
24. The owner cannot accept responsibility for any property or thing left behind at the Cottage after your Holiday.
25. We try to ensure the accuracy of the information given and all our representations have been made in good faith all errors and omissions accepted.
